Terms and Conditions

These Terms and Conditions (“Terms”) apply to all applications published by OpenChatsAI (“we,” “our,” or “us”) on the Apple App Store (each an “App,” together the “Apps”) and to our website, openchatsai.com. Please read them carefully.

1. Acceptance of Terms

By downloading, installing or using any of our Apps, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use our Apps. A specific App may include additional terms, which apply together with these Terms.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use our Apps. If you are under the age of majority where you live, you may use the Apps only with the involvement and consent of a parent or legal guardian. Some Apps may have a higher age requirement, as shown on their App Store page.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use our Apps for your personal or commercial purposes on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

4. Accounts

Some Apps may require an account. You are responsible for keeping your login details secure and for all activity under your account. Please tell us promptly at support@openchatsai.com if you believe your account has been accessed without permission. You can delete your account at any time from within the App or by contacting us.

5. AI Features

Many of our Apps include features powered by artificial intelligence (“AI Features”). By using them, you understand and agree that:

  • Output may be inaccurate. AI-generated content (“Output”) is produced automatically and may be incorrect, incomplete, offensive or out of date. Always review Output before relying on it.
  • Not professional advice. Output is not medical, legal, financial, psychological or other professional advice, and must not be used as a substitute for advice from a qualified professional. In an emergency, contact your local emergency services.
  • Your responsibility. You are responsible for the content you submit (“Input”) and for how you use Output, including making sure your use complies with applicable laws and does not infringe the rights of others.
  • Ownership. As between you and us, you keep any rights you have in your Input, and to the extent permitted by law, we assign to you any rights we may have in the Output generated for you. Output may not be unique, and other users may receive similar Output.
  • Third-party AI providers. AI Features may rely on third-party AI service providers to process your Input, as described in our Privacy Policy.
  • Content moderation. We may use automated systems to filter, block or refuse Input or Output that violates these Terms, and we may limit or suspend access to AI Features to prevent abuse.
  • Changes. AI Features, models and providers may change over time, and results may vary.

6. Acceptable Use

You agree not to use our Apps, including AI Features, to:

  • Break any law or encourage illegal activity.
  • Create, upload or share content that is abusive, harassing, hateful, sexually explicit, violent or that exploits or harms minors in any way.
  • Generate or spread misinformation, spam, scams or malicious code.
  • Impersonate any person or organization, or create deceptive content about real people.
  • Infringe intellectual property, privacy or other rights of others.
  • Attempt to bypass safety filters, usage limits or security measures.
  • Reverse engineer, decompile, modify or create derivative works of any App, except where permitted by law.
  • Scrape, harvest or extract data from the Apps by automated means, or use Output to develop competing AI models.
  • Interfere with or disrupt the Apps, our servers or networks.

7. Your Content

You grant us a limited, worldwide, non-exclusive license to host, store, process and transmit your Input and other content you submit, solely to operate, provide, secure and improve the Apps for you, as described in our Privacy Policy. We do not claim ownership of your content.

8. Purchases and Subscriptions

Some Apps offer paid features, in-app purchases or auto-renewable subscriptions.

  • All payments are processed by Apple through your Apple Account and are subject to Apple’s terms.
  • Subscriptions renew automatically at the end of each billing period unless canceled at least 24 hours before the current period ends. Your account will be charged for renewal within 24 hours before the end of the current period.
  • You can manage or cancel subscriptions at any time in Settings > [your name] > Subscriptions on your device. Deleting the App does not cancel a subscription.
  • Any unused portion of a free trial is forfeited when you purchase a subscription.
  • Refunds are handled by Apple under its refund policies. We cannot issue refunds for App Store purchases directly.
  • Prices and features may change. Price changes for subscriptions will be communicated in line with Apple’s rules.

9. Apple App Store Terms

For Apps downloaded from the Apple App Store, you and we acknowledge that:

  • These Terms are between you and OpenChatsAI only, not Apple Inc. (“Apple”). We, not Apple, are solely responsible for the Apps and their content.
  • Apple has no obligation to provide any maintenance or support for the Apps.
  • If an App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for that App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Apps.
  • We, not Apple, are responsible for addressing any claims relating to the Apps or your use of them, including product liability claims, claims that an App fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
  • If a third party claims that an App or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defense, settlement and discharge of that claim.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • You must comply with any applicable third-party terms when using the Apps.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

10. Third-Party Services

Our Apps may link to or integrate third-party services. We are not responsible for third-party services, and your use of them is subject to their own terms and privacy policies.

11. Intellectual Property

All rights in our Apps and website, including software, design, text, graphics, logos and branding, belong to OpenChatsAI or our licensors, except for your content and Output as described above. Nothing in these Terms transfers those rights to you.

12. Feedback

If you send us ideas or suggestions, you allow us to use them freely without any obligation to you.

13. Availability and Changes

We may update, change or discontinue any App or feature at any time. We do not guarantee that our Apps will always be available, uninterrupted or error-free.

14. Disclaimer

To the maximum extent permitted by law, our Apps and all Output are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

15. Limitation of Liability

To the maximum extent permitted by law, OpenChatsAI will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or revenue, arising from your use of, or inability to use, our Apps or any Output. Our total liability for any claim relating to the Apps will not exceed the amount you paid for the App or subscription in the 12 months before the claim, or USD 50, whichever is greater. Some jurisdictions do not allow these limitations, so they may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless OpenChatsAI from claims, losses and expenses (including reasonable legal fees) arising from your misuse of the Apps, your content, or your violation of these Terms or the rights of others.

17. Termination

You may stop using our Apps at any time. We may suspend or terminate your access if you violate these Terms or if needed to protect our users, our services or others. Sections that by their nature should survive termination, such as Intellectual Property, Disclaimer, Limitation of Liability and Governing Law, will continue to apply.

18. Governing Law

These Terms are governed by the laws of the Kingdom of Bahrain. Any disputes arising out of or relating to these Terms or the Apps will be subject to the exclusive jurisdiction of the courts of the Kingdom of Bahrain, except where consumer protection laws in your country give you the right to bring a claim locally.

19. Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised “Effective Date.” Continued use of our Apps after changes take effect means you accept the updated Terms.
